Vertafore shall not be liable to You or deemed in breach of these Terms of Service for its failure or delay in performing any of its obligations under this these Terms of Service during any period in which such performance is rendered impracticable or impossible due to circumstances beyond our reasonable control, including, but not limited to, acts of God, fire, explosion, flood, drought, riot, disease outbreaks, sabotage, terrorism, war, invasion, embargo, strikes or other labor trouble, failure in whole or in part of suppliers to deliver materials, equipment or machinery, interruption of or delay in transportation or telecommunications or compliance with any order or regulation of any government entity acting with color of right. If any of these events (or similar) prevent us from fulfilling our obligations to You under these Terms of Service, we’ll do our best to communicate with You and find solutions.

5. EXPORT COMPLIANCE

 By ordering from us, You confirm that:

Some of our goods live online only. These products may be in limited supply and are subject to our Return Policy.

We've worked hard to get the colours and images just right, but we can't promise your screen sees what we see.

We may limit who we sell to or how many of something we sell – it's nothing personal. We just like to keep things fair.

All descriptions, prices, and availability may change without notice. Sometimes stuff sells out. Sometimes things just don't work out.

We can't guarantee You will  love everything – but we hope you do. Let us know if there's a problem and we'll try to make it right.

Due to supply chain and international regulations, availability of certain products may vary.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to, product availability, errors in the description or prices for products or errors in your order.

We reserve the right to refuse or cancel your Order if fraud or an unauthorized or illegal transaction is suspected.

Any Products You purchase can only be returned or refunded in accordance with these Terms of Service and our Returns and Refunds Policy.

9. PROMOTIONS

Any promotions made available through the site may be governed by rules that are separate from these Terms of Service.

If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will prevail.

9. PRE-ORDERS

Pre-Order Policy
 Sometimes we'll offer products before they're ready to ship. Here's how pre-orders work:

  • We'll clearly mark pre-order items and expected shipping dates

  • Payment is taken when You place the order

  • If dates change, we'll email You with updates

  • You can cancel pre-orders anytime before shipping for a full refund

  • Pre-orders can't be combined with regular stock items in one shipment

  • All other return and refund policies apply once the item ships

10. GIFT CARDS

Gift Card Terms

  • Gift cards don't expire (because that's just mean)

  • They can't be redeemed for cash

  • Lost or stolen gift cards can't be replaced

  • Gift cards can be used for multiple purchases until the balance runs out

  • No returns or refunds on gift card purchases

  • Gift card balances aren't transferable between customers

11. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order You place with us. We may limit or cancel quantities, and if that happens, we'll try to let You know via email or phone.

 All our products meet Australian safety standards and are suitable for their intended use. We stand behind the quality of everything we sell.

Warranty Coverage:

  • Manufacturing defects: Full replacement or refund

  • Material failures under normal use: Repair, replace, or refund

  • Customisation errors (our fault): Free re-customisation or refund

What's Not Covered:

  • Normal wear and tear

  • Damage from misuse or accidents

  • Modifications You make after purchase

  • Items damaged after successful delivery

19. DISPUTE RESOLUTION

Let's Sort This Out

For Our Customers:
If something goes wrong, let's chat first. Email us at hello@afternoonsocialclub.com and we'll try to fix it informally. We love our community and will always try to do our best by You. If that doesn't work, we'll try mediation through the Australian Disputes Centre. These Terms are governed by NSW law, and any legal proceedings will be in NSW courts.


We'd prefer to work things out between us, but if we can't, here's how disputes get resolved:

Binding Arbitration:  Any dispute, controversy or claim arising out of, relating to or in connection with this contract, including any question regarding its existence, validity or termination, shall be resolved by arbitration. The seat of arbitration shall be Sydney, NSW Australia. The language of the arbitration shall be English.

Class Action Waiver: You agree that disputes will be resolved individually, not as part of a class action, collective action, or representative proceeding. This means no joining with other customers to sue us as a group.

20. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that the results that may be obtained will be accurate or reliable.

To the fullest extent permitted by law, including the Australian Consumer Law, we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these Terms. However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.

Where any law (including the Australian Consumer Law) implies a warranty or condition into these Terms which cannot be lawfully excluded, our liability for breach of such a warranty or condition is limited, at our option, to one or more of the following:

(a) in the case of goods: the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or acquiring equivalent goods; or the payment of the cost of having the goods repaired; and

(b) in the case of services: the supply of the services again; or the payment of the cost of having the services supplied again.

To the extent permitted by law, we (including our directors, officers, employees, affiliates, agents, contractors, suppliers and licensors) are not liable for any indirect, incidental, special or consequential loss or damages whatsoever including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms) arising out of or in connection with your use of the Service or any products procured using the Service.

Our liability in connection with your use of the Service or any products purchased through the Service is limited to the amount You paid us in the 12 months preceding the claim, except where otherwise required by law.

21. INDEMNIFICATION

You agree to hold Afternoon Social Club and our team harmless if your misuse of our site or violation of these terms causes trouble.

22. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

23. TERMINATION

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.

Upon termination, your right to use the site will cease immediately. If You wish to terminate your account, You may simply discontinue using the site.

24. WAIVER

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

For customers outside Australia, pricing is shown and charged in the local currency of the country in which You are shopping. Currency is automatically selected based on your location.

27. CONSUMER GUARANTEES

Our products come with guarantees that can't be excluded under Australian Consumer Law. If there's a major issue, you're entitled to a refund, replacement, or compensation.
